PLEASE READ THE TERMS OF THIS FAIR USAGE USE POLICY CAREFULLY BEFORE USING THIS SERVICE.

BY CONTINUING TO USE THE SERVICE, YOU AGREE TO BE BOUND BY THIS POLICY. 

IF YOU DO NOT AGREE TO ABIDE BY THIS POLICY, PLEASE DO NOT USE THE SERVICE. 

This Policy sets out the standards that apply when you make use of the “MiaPlus” chat bot service (the Service).  It should be read alongside our end user licence terms which can be accessed here:

1. Use of the Service 

1.1 You must not use the Service: 

  1. for any purpose other than the fair and responsible use of the Service and the information (output) that you obtain from your use of it; 
  2. to mislead, defraud, scam, bully, manipulate, insult, harm, abuse, intimidate, humiliate, exploit, defame, harass, or spam the ICAEW or any third party (or attempt to do so);  
  3. to elicit, use or share any output for the purposes listed in paragraph 1.1(b) above;  
  4. to generate and/or disseminate information (output) which is false or misleading; 
  5. to infringe or otherwise violate any third party’s rights; 
  6. in any way that breaches any applicable local, national or international law or regulation; 
  7. in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect; 
  8. to compromise the privacy of any person; 
  9. to send, knowingly receive, upload, download, use or re-use any material in breach of paragraph 1.2(a) below; or 
  10. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the security or operation of the Service or of any computer software or hardware. 

1.2 You also agree: 

  1. that your input (requests) to the Service will not: 
    • contain any personal data (whether your own or of any other person); 
    • be defamatory, profane, obscene, offensive, hateful or inflammatory; 
    • bully, insult, intimidate or humiliate; 
    • incite violence or hatred; 
    • be deceptive or likely to deceive; 
    • promote or encourage discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; 
    • include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or xenophobia; 
    • infringe any copyright, database right or trade mark of the ICAEW or any third party; 
    • breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence; 
    • be in contempt of court; 
    • be threatening, abusive or invade another's privacy; 
    • impersonate any person or misrepresent your identity or affiliation with any person;  
    • breach any applicable law; or 
    • advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse. 
  2. not to circumvent (or seek to circumvent) any of the safeguards, safety mitigations,  security or other protective measures in the Service; 
  3. not to reproduce, duplicate, copy or re-sell any part of the Service in contravention of the provisions of our end user licence terms for the Service, or attempt to do so;  
  4. not to access without authority, interfere with, damage or disrupt: 
    • any part of the Service; 
    • any equipment or network on which the Service is stored;  
    • any software used in the provision of the Service; or  
    • any equipment or network or software owned or used by any third party. 

1.3 You acknowledge that we will retain a record of all conversations via the Service for the purpose of monitoring and ensuring the integrity of the Service.  Whilst such conversation logs do not identify individual users of the Service, in the event of any dispute between us, the log of your conversation with the Service may be referred to where you have informed us of the date, time and subject matter of your use of the Service.  

2. Breach of this Policy 

2.1 Where we consider that a breach of this Policy has occurred, we may take such action as we deem appropriate.   

2.2 Failure to comply with this Policy constitutes a material breach of our end user licence terms for the Service upon which you are permitted to use the Service, and may result in our taking all or any of the following actions: 

  1. issue of a warning to you; 
  2. legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; 
  3. further legal action against you; and/or 
  4. disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law. 

2.3 We exclude our liability for all action we may take in response to breaches of this Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
