Take note of the latest disciplinary cases to ensure you or your firm are not making similar mistakes.
Since the last update, five tribunal orders, four consent orders from the Conduct Committee, and three settlement orders have been published.
Included within the latest published orders are the following:
- a breach of the Guidance contained within Regulation 18 of the Level 7 Accountancy Professional Apprenticeship Certificate Regulations (effective 15 March 2018);
- breaches of the ICAEW Clients’ Money Regulations 8A for receiving money into the firm’s client account which did not relate to accountancy services performed, or due to be performed, by the firm;
- the signing of an audit opinion when the audit of certain areas did not comply with ISA 200, ISA 230, ISA 500, and ISA 570, and the financial statements did not comply with the Financial Reporting Standard for Smaller Entities in respect of the accounting treatment of income and loans; and
- a breach of the requirements of the Audit Regulations (effective from 1 January 2021 – 4 December 2022) as set out in Regulations 4.01 – 4.05 inclusive, as a number of audit reports were signed when the individual’s application for Responsible Individual’s status at the firm had not been approved.
